No. 2/SA-24/2009(1)/FSSAI.—The following draft of the Food Safety and Standards (Alcoholic Beverages Standards) Regulations, 2016, which the Food Safety and Standards Authority of India proposes to make with the previous approval of the Central Government, in exercise of the powers conferred by clause (e) of subsection (2) of section 92 read with sub-section (2) of section 16 of the Food Safety and Standards Act, 2006 (34 of 2006), is hereby published as required under sub-section (1) of section 92 of the said Act, for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of the Gazette containing this notification are made available to the public; Objections or suggestions, if any, duly supported with scientific evidence, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Delhi – 110002 or send it to the email address of the Food Authority at regulation@fssai.gov.in ; Objections and suggestions, which may be received from any person with respect to the said draft regulations before the expiry of the period specified above, shall be considered by the Food Safety and Standards Authority of India.

The standards specified in these regulations shall apply to distilled and un-distilled alcoholic beverages.

Distilled Alcoholic Beverage Standards

Brandy – Brandy is alcoholic liquor made from fruits such as grapes or other fruits that possesses distinctive colour, odour and taste of its own.

Tequila: 2.6.1 Tequila is the distilled alcoholic beverage made from the blue agave juice or minimum 51 per cent. blue agave juice. It is prepared in the area surrounding the city of Tequila (Mexico) as per the laws applicable thereto. It is prepared by double distillation and some brands are distilled third time also. 2.6.2 Tequila shall contain 31-55 per cent alcohol by volume at 20 degree C. 2.6.3 Tequila shall be aged in oak barrels. 2.6.4 Tequila shall be free from chloral hydrate, ammonium chloride, diazepam, paraldehyde or any other types of narcotic, psychotropic substances* including caffeine which, when mixed with alcohol, is injurious to health. 2.6.5 The water used for dilution to bottling strength should be as per IS:10500.
